Government Immune from Claims Under Digital Millennium Copyright Act 
 
The government cannot be sued for claims arising under the Digital Millennium Copyright Act, the U.S. Court of Appeals for the Federal Circuit held July 25.  Because the DMCA, 17 USC §1201, does not contain an express waiver of sovereign immunity, the government is immune from claims pursued under it, Judge Arthur J. Delaware Enacts Legislation Limiting Residents' Use of Internet Pharmacies 
 
Internet pharmacies may not sell prescription drugs to Delaware residents unless there is a bona fide practitioner-patient relationship between the provider writing the prescription and the patient for whom it is written, legislation signed July 21 by Delaware Gov. Ruth Ann Minner (D) provides.  The legislation, the Safe Internet Pharmacy Act (H.B. 454), was effective immediately upon enactment.  It establishes penalties for practitioners, pharmacists, and individuals who violate the requirement for a legitimate patient-practitioner relationship in connection with Internet prescription drug sales.  Subscribers read more ...

Prima Facie Libel Showing Required for Identification of Unnamed Web Speaker 
 
Parties seeking to identify an individual who posted anonymous comments online must make a prima facie showing of libel to overcome the individual's right to speak anonymously, the U.S. District Court for the District of Connecticut held June 13.  Some courts have only required a plaintiff to establish a "good faith basis" for a claim or show probable cause to overcome a defendant's First Amendment right to speak anonymously, but those standards set the bar for compelling disclosure too low, Judge Christopher F. ISP Tells Lawmakers It Has No Plans to Continue Consumer-Tracking Tests 
 
In the wake of congressional scrutiny, Internet service provider Embarq Corp. is distancing itself from a controversial technology used to track customers' web activity in order to deliver targeted advertisements.  In a July 23 letter to leaders of the House Energy and Commerce Committee, Embarq acknowledged using the technology in a "consumer preference marketing" test that ended earlier this year.  However, the company said that no customer data continues to exist, and the firm has "no plans for more tests or for general deployment of this technology, until such time as privacy concerns have been addressed."  Subscribers read more ...

Streamlined Sales Tax Committee Approves Draft Rule on Sanctions 
 
The Executive Committee of the Streamlined Sales Tax Governing Board approved a draft rule July 23 addressing sanctions against member states found out of compliance with the terms of the Streamlined Sales and Use Tax Agreement.  Approved as part of the draft was new language stating the Executive Committee shall consider the action that resulted in noncompliance, the action that will be required to bring the state back into compliance, and the length of time it will take for compliance.  Subscribers read more ...

Posting Copies of Protected Works Online Supports Jurisdiction Where Owner Resides 
 
A Canadian company which posted works belonging to a New York company on its website was subject to the specific personal jurisdiction of a New York court in a subsequent infringement action, the U.S. District Court for the Southern District of New York held July 7.  Because the defendant generated approximately ten percent of its international revenue from New York residents via the website, and the claim arose from transactions there, it fell squarely within the state long-arm statute's provision for jurisdiction over parties "transacting business" within the state.  M.
