News INTELLECTUAL PROPERTY Court Affirms Construction of Term
'Local' in Proceeding Against Oracle Software The term "local,"
referring to memory devices attached to computers joined in a network, was
correctly construed to mean a device directly attached to a single
computer on the network, the U.S. Court of Appeals for the Federal Circuit
ruled May 14. Affirming a federal district court's claim
construction ruling, the court also upheld an award of summary judgment in
favor of Oracle Corp., which was defending software sold as part of its
database software packages from a claim of patent infringement.

INTERNET COMMERCE MySpace Wins $224 Million Default
Judgment for CAN-SPAM, State Anti-Phishing
Violations
In the largest award under the CAN-SPAM Act, and the first
award made under California's anti-phishing law, two well-known Internet
spammers were ordered May 12 by a federal judge in a default judgment to
pay MySpace, Inc. more than $224 million for illegal "phishing" and
spamming on MySpace's network in violation of the popular online
networking site's terms of use contract and federal and state law.

Senate to Consider Legislation
Compelling U.S. Companies to Resist Internet
Censorship
The time may have come to make the goal of promoting free
expression for foreign Internet users a legal—not just a moral—imperative
for high technology companies, Sen. Richard J. Durbin (D-Ill.) said May
20. U.S. Internet companies have provided a great deal of the
infrastructure and services that enable the free exchange of information
online, and that constant transfer and interactive dialogue is why the
Internet has seen such wild success, Durbin said. But he questioned
whether these companies that have done so much to allow free speech should
be permitted to pander to governments with oppressive censorship regimes

TELECOMMUNICATIONS Panelists Debate Various FCC Options for
Regulating Network Neutrality Practices Former government
officials, now in the private sector, May 15 outlined the various ways
that the Federal Communications Commission could regulate net neutrality
and the likelihood that any would be upheld by the courts.
Separately, a group of public interest organizations released a study by
the Max Planck Institute in Germany showing that both Comcast and Cox
Communications are blocking web traffic over their networks at all

PRIVACY & SECURITY U.K. to Add Internet Traffic to Telecom
Data Retention Law Telecommunication companies in the
United Kingdom would have to keep logs of Internet traffic and make such
data available to the police to combat terrorism and organized crime,
under a proposed law to be introduced in Parliament in November, Prime
Minister Gordon Brown announced May 13. The Communications Data
Bill, if passed during the 2008-2009 Parliament, would finalize the U.K.'s
adoption of telecommunications data retention laws to implement the

TAXATION NCSL Panel Wants SST Governing Board to
Determine Small Business Exemption Federal legislation (S. 34) that would
establish a $5 million threshold for businesses to be covered by the
Streamlined Sales and Use Tax Agreement needs to be changed, a panel of
state legislators recommended May 16. If successful, the
recommendation of the National Council of State Legislators would strip
the threshold of $5 million in online commerce revenue from the Sales Tax

Location Is 'Something More' Satisfying 'Effects
Test'
A Canadian company that operated a website allegedly infringing a
competitor's trademark, with actual knowledge that the competitor was
located in Idaho, was subject to the specific personal jurisdiction of an
Idaho court in an action arising from the operation of the website, the
U.S. District Court for the District of Idaho held May 7. The
Canadian company's knowledge that its competitor was located in Idaho
provided the "something more" necessary to satisfy the "effects test" for
specific personal jurisdiction set forth in Calder v. Jones, 465

CRIMINAL LIABILITY Woman Who Allegedly Used MySpace to Push
Teen to Suicide Indicted Under CFAA A woman who allegedly created a false
profile on the MySpace website and used that account to harass a teenaged
girl who later committed suicide was indicted May 14 by a grand jury for
violations of the federal Computer Fraud and Abuse Act. The grand
jury, sitting in the U.S. District Court for the Central District of
California, indicted her for alleged violations of the CFAA, 18 USC §1030,
stemming from her use of the social networking service in violation of its
terms of use, finding that she may have accessed MySpace servers "without
